1. ACCEPTANCE OF TERMS & CONDITIONS

1.1 This agreement governs the relationship between Impeccable Services Limited (to be referred to here as Impeccable Services and [website address] and Jobseekers (to be referred to here as “You” or “Users”,) in relation to the usage of the website and the submission, saving, sending, or posting of contact details, a CV / Resume and connected personal data.

1.2 By completing the registration process for using the service on the Impeccable website you agree to be bound by all of the following terms and conditions.

1.3 The User agrees to the Privacy Policy of this [website].

1.4 You acknowledge that the Website is intended to facilitate introductions being made with regard to employment. You confirm to us that in your dealings with each other you shall act in good faith and in a business-like and courteous way and keep strictly confidential all confidential information disclosed to you pursuant to using the services of Impeccable Employment Services.

1.5 You agree:

• That you must be Eighteen Years Old or older
• To have only one account on our website, which must be in your real name.
• To provide true, accurate, current and complete information when registering as a user of the Service and notify us immediately of any changes in such user information or status.
• that any personal data attached and/or submitted by the User as part of a job application or entered by the User on a publicly visible resume on this site is the sole responsibility of the User.
• To take a psychometric test aimed to show your overall suitability for a particular role based on how you perform.
• To participate in all training sessions which are detailed in Clause 2. These sessions are mandatory and must be completed in order for your profile to be made public for viewing and search on the database.
• To submit a Police report if and where prompted to and to be willing to cooperate with the facilitators of Impeccable Services where conducting a background check and to make yourselves accessible to undergo a telephone screening.

1.6 You agree not to:

• Impersonate another person or use a false name or a name you are unauthorized to use or create a false identity or e-mail address or try to mislead others as to the identity or origin of any communications.
• Obtain or attempt to obtain unauthorized access, through whatever means, to our database, which is identified as restricted.
• Replicate any available material available on the Website unless such copying is solely for your personal use in relation to a job advertised or sought, and in any event, you agree not to exploit any material copied from the Website in any way for any form of commercial gain.
• Use the services provided on Impeccable Services for unlawful purposes when seeking employment. You must not under any circumstances seek to undermine the security of the Website or any information submitted to or available through it. You are also responsible for ensuring that all information, data, and files uploaded to [website name] are free of viruses.

2. THE SERVICE OFFERED CONSISTS:

• Providing you with the ability to apply for jobs posted on Impeccable Services and to supply copies of your personal/contact details, and resume for the purposes of obtaining employment, in the format specified by Impeccable Services to the prospective employers/recruiters you directly apply to online.
• Providing you with a platform that allows for marketing to Prospective Employers, for the purposes of obtaining employment.
• Providing you with a Resume Workshop that will afford detailed explanations, as well as step-by-step processes, for creating an effective resume allowing for a successful job search.
• Providing you with mandatory training sessions that will include but are not limited to
• Customer Service Training;
• Workplace Etiquette; and
• Health & Safety Protocols

3. PAYMENT

3.1 For Users the service is free and we will not charge you any monthly or annual service fee for the use of this database. Users however agree to pay to Impeccable Services 30 % of their salary twice upon gaining long-term employment and 20% of their salary upon gaining short-term employment.

4. SOLICITATION

4.1 your Subscription to Impeccable Services, the User agrees that he/she will not solicit any other User or Recruiter of Impeccable Services on behalf of themselves, any other business enterprise, nor shall he/she induce any User or Recruiter associated with Impeccable Services to terminate or breach contractual or other relationship with the Company.

4.2 For a period of one (1) year following the termination of your subscription and your relationship with Impeccable Employment Services, the User agrees to not, directly or indirectly, disclose to any person or corporation the names and addresses of any of the Users or Recruiters of the Company or any other information pertaining to them. Neither shall the user call on , solicit , take away , or attempt to call solicit or take away any customer of the Business on whom you have called.

5. PRIVACY

5.1 Please refer to our Privacy Policy for full details of Impeccable Services commitment to privacy.

6. LIMITATION OF LIABILITY

6.1 Impeccable Services shall not be liable for:

• Inaccuracy of any job details, the unavailability of the job in question or the conduct of any potential employer or party who places an advertisement on this website, or who uses this website for any other purpose;
• Any losses you may make, any damages or personal injury you may suffer, or costs or penalties you may incur through your application to or correspondence with, trust in, association with, or employment with any employer, recruiter, person or which has / had an job listing at any time on [ website name];
• Any interruption in the use of this web site, and no liability can be accepted in respect of losses or damages arising out of such unavailability.

6.3 Users acknowledge and accept that [website name] does not represent, and is not affiliated with any employer / recruiter / advertiser on this website. Users acknowledge that [website name] is simply a passive conduit for the distribution of information between Users of this website with employers/recruiters and that [website name] does not screen all information submitted to, or communicated by this website.

6.4 [Website name] is merely a market place in which various proposals and offers may be learned of and applied for or visited via a website link. [website name] assumes no responsibility for ensuring that any such information is legal, decent, non-discriminatory, honest, truthful, up to date, accurate, complete or not misleading or that it possesses any other such characteristics.

6.5 The User acknowledges and accepts that [website name] has no control whatsoever over the user preferences and decisions of any individual employer, company, recruiter or third party entering employment information on this site.

6.6 All advice and information supplied by [website name] under the Service will be supplied in good faith but Impeccable Service gives no guarantee as to any advice or information it supplies nor that following submission of your resume to any prospective employer that you will be interviewed or employed or you will receive a response, or that you will be suitable to meet the requirements of that employer or recruiter.

7. INDEMNITY

You agree to indemnify and hold us, and any of our officers, employees and agents harmless from and against all and any expenses, losses, liabilities, damages, costs or expenses of any character incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of, or conduct on, the Service and/or a breach of these Terms.

8. GOVERNING LAWS

8.1 These Terms shall be governed by and construed in accordance with the laws of Jamaica and you agree with us to submit to the jurisdiction of the Jamaican courts.

8.2 If any provision of these Terms is held by a court of competent jurisdiction to be contrary to the law, then such provisions shall be construed as far as possible to reflect.

8.3 You agree that in the event a dispute arises between the parties to this contract it is hereby agreed that the dispute shall be referred to Arbitration at first instance.

8.4 You agree with us that any cause of action arising out of or relating to the Service must be commenced within one year after the cause of action arose otherwise such cause of action is permanently barred.

8.5 Our failure to exercise any particular right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us to you in writing.

8.6 Nothing contained in these Terms shall be deemed to constitute a partnership between you and us and you shall not have the authority to bind us in any way.

9. ALTERATIONS TO THESE TERMS

We reserve the right to amend these Terms at any time and we will notify you of the same. Your account will be terminated if you do not accept such changes
